Cornyn: Democrats Searching for Excuses to Oppose Gorsuch

On the third day of Judge Neil Gorsuch’s confirmation hearing, I on the Senate Floor highlighted the support Judge Gorsuch has received from both sides of the aisle and the shifting reasons Democrats have offered to oppose his nomination. Excerpts of my remarks are below, and video of my remarks can be found here.

The bipartisan recognition of Judge Gorsuch's fitness for this high office is really nothing new because a decade ago, ten years ago, he was confirmed by the United States Senate by voice vote, essentially unanimously. Not one member of the Senate opposed his confirmation.

So in truth, he is a great jurist, and that's clear by the evolving reasons coming from our friends on the other side of the aisle as to why they have some concerns.

First, we heard some Senate Democrats say they would fight a nominee that wasn't in the mainstream. Well, Judge Gorsuch passed that test with flying colors, and so they moved on.

Next, they implied they might oppose him because of his refusal to answer questions about issues that would come before the Court. Well, as I said, not only do the ethics rules prohibit him from doing that, but the tradition set by Justice Ginsburg and Kagan rightfully dictates that he refuse to do so during the hearings.

Now we're hearing from some of our Democratic colleagues that his vote must be delayed because of an ongoing FBI investigation that's completely unrelated to him. Well, I think that just is an indication of how desperate they are to come up with a reason, any reason to oppose this judge's confirmation.

Indeed, they're struggling to do so and they're desperate for an excuse to oppose him, but they're not going to find a good excuse or a good reason.

I would ask them this: if you can't vote for somebody like Judge Gorsuch, you're not going to be able to vote for any nominee from a Republican president because there simply isn't anybody better qualified by virtue of his experience, his education, his training, and his temperament for this job.
