Is the Southern District of New York (SDNY) becoming the laughing stock of our nation's bankruptcy courts? After Chief Judge Cecelia Morris' appearance on Fox Business a couple of weeks ago, that just might be the case. I found this story while researching the SDNY on Bankruptcy Law Review. It seems Judge Morris wants to now blame all of the failings of her district's courts on the fiscal sequestration that is really just now starting to affect government entities. Creditors of the City of Stockton, California probably wish that Judge Christopher Klein's ruling that the city can proceed into bankruptcy over their objections was an April Fools joke, but it just isn't so. Monday, April 1, Judge Klein accepted the bankruptcy application of Stockton after creditors walked away from negotiations.

It is good to see a bankruptcy judge who won't let creditors walk all over him, unlike Judge Robert Gerber who let creditors in the General Motors bankruptcy case make a fool of him by hiding a $367 million payment to GM Canada. Because of this, Gerber is having to revisit this case and the entire GM bankruptcy could come unraveled.   Read more »

Is 44 days too fast to move a bankruptcy the size of General Motors (GM) through the courts system without missing something major?  Apparently so, as Judge Robert Gerber, in the Southern District of New York (SDNY) Bankruptcy Court, is now having to revisit this case because of some potentially damaging issues involving the Canadian subsidiary of GM and alleged improper transfer of assets to hedge funds. President Barack Obama has been on a mission of abusing the bankruptcy courts to move forward his political agenda of redistribution of wealth and making paybacks to unions for political support. This directly affects voters in key battleground states. The Delphi, General Motors and Chrysler bankruptcies are perfect examples of how the Obama Administration abused the process of bankruptcy courts to steal pensions, violate contract law and provide rewards to unions he needed for support in this election process

President Barack Obama and Vice President Joe Biden have made their bailout of General Motors Company (GM) the shining star on their re-election tree. Their claim is they saved the jobs of GM employees.

Vice President Joe Biden likes to cheer "Osama Bin Laden is Dead and GM is Alive!" But what he doesn't tell you is that since the illegal GM bankruptcy, President Barack Obama has been hard at work as the "Job-Exporter-in-Chief" moving thousands of high paying, middle-class, NON-UNION jobs to China. GM, the shining star on top of the Obama Re-Election "Winter Holiday Tree", is leaving town quickly and what's left is circling the drain.  

In talking with former GM employees, I learned Obama has been sending non-union jobs like product design, engineering and drafting jobs to China.
