National Defense Authorization Act, Slight Return

I want to make just a short follow up to my last installment of the Daily Rant. Can the president use the military to arrest anyone he wants, keep that person hidden away from a judge and jury, and lock him up for as long as he wants? Well, Senators Levin and McCain want him to be able to in direct opposition to your God given, Constitutional rights. It is a terrifying vision of the soon coming United States of America and the former shell of what was once the bright shinning hope of free men throughout the world, the Constitution.

Your American government loves secrecy and hates transparency. With all of the Hope and Change and “Transparency” promised by the left wing and Democratic Party's new messiah being cast aside like a used prom date, we see just how much “transparency there is.

Transparency is like a bright light turned on in a dark kitchen. It forces the vermin to run and hide. Cockroaches and lice infested rats will do their best not to be seen by you and will try to hide away in the shadows. In like manner, the Congress and Administration is working in darkness to steal your freedoms and way of life. Openness and transparency forces the government to answer to us. Secrecy lets it steal our liberty and our property behind our backs.

Last week the Senate Armed Services Committee met in secret behind closed doors and drafted an amendment to a bill appropriating money for the Pentagon. The amendment would permit the president to use the military for law enforcement purposes in the United States.

This may be wrong but it seems to say something like this in the Constitution that the Congress is supposed to work in public:

The Constitution of the United States; Article I - The Legislative Branch; Section 5 - Membership, Rules, Journals, Adjournment;

(5th Line) Neither House, during the Session of Congress, shall, without the Consent of the other, adjourn for more than three days, nor to any other Place than that in which the two Houses shall be sitting. (Doesn’t meeting in secret break this rule? I’m just saying…)

This National Defense Authorization Act bill is an attempt to fundamentally change our Republic. In the same manner that Barack Hussein Obama wants to change the United States, Senators Levin and McCain are doing the same. You all remember Little Johnny McCain don’t you? He’s the War hero, servant of the Republic, partner in the Campaign Finance Reform Act. First he wants to take away your right to support the candidate of your choice with your own money, and then he wants to take you from your home in the middle of the night and put you in Gitmo and leave you there. Doesn’t the Constitution say something about this? Let’s see, I know I’ve seen it here…somewhere…Oh. Here it is.

The Constitution of the United States; Article I - The Legislative Branch; Section 9 - Limits on Congress;

The privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.( Habeas Corpus: habeas corpus n. Law A writ issued to bring a party before a court to prevent unlawful restraint. [

No Bill of Attainder or ex post facto Law shall be passed. (Attainder: attainder n. The loss of all civil rights by a person sentenced for a serious crime. [< OFr. attaindre, to convict])

The basic premise behind habeas corpus is that you cannot be held against your will without just cause. You cannot be jailed if there are no charges against you. The courts must issue a writ of habeas corpus, which forces those holding you to answer as to why. As an aside, it is important to realize that of all the civil liberties we now take for granted as a part of the Bill of Rights, the importance of habeas corpus is shown by the fact that it was the sole liberty thought important enough to be included in the original text of the Constitution.

The Bill of Attainder could be used against an American under this bill if the powers that be decide that you or I need to be silenced. Has the Constitution stopped anything done by this Congress or the last two administrations?

What about the following?

The Constitution of the United States; The Amendments;

Amendment 3 - Quartering of Soldiers. Ratified 12/15/1791. No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.

Amendment 4 - Search and Seizure. Ratified 12/15/1791.The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Amendment 5 - Trial and Punishment, Compensation for Takings. Ratified 12/15/1791.No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

Amendment 6 - Right to Speedy Trial, Confrontation of Witnesses. Ratified 12/15/1791. In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defense.

The last Presidential election should have shown the American people, beyond a shadow of a doubt that our Republic is on the precipice of extinction. The past three years have increased the speed of its demise by a thousand fold. Everyday, those in Washington continue to seek ways of taking your money and your freedom. Why is it that they feel the need to bring the most powerful military power in the history of the world to confront its own people? Why do they want to use our son’s and daughters that have taken an oath to preserve, protect and defend the Constitution of the United States to take away the freedoms granted through it by God to its people? Makes one think doesn’t it?

The last election came down to two cartoon characters. One that reminds us of that lovable Yosemite Sam and the other, well, I’ll leave that up to you. This election seems to be coming down to the GOP insiders pick of Romney and the current President. Where’s the real choice there. Call and write your Senators and Congressman. It may be close to being too late

Now that this dangerous and unconstitutional bill has passed the senate, the only hope to kill it is through a presidential veto. Obama has threatened to veto, so DEMAND that he do by signing the petition on the White House website (link below). Spread the word.

The Obama administration is against Levin's provision, and has threatened to veto if it reaches his desk.

This is not JUST a slippery Slope. this taking the Constitution, Bill of Rights and throwing them down the GRAND CANYON and filling the canyon with dirt. It embarrasses me to say that on of my Texas GOP Senators approved this (John Cornyn). It is time to tell the RHINOS, The TEA PARTY WANNABEE SHMOOZERS. that 2010 was not a fluke. If these SOB's think that just because they are INCUMBENTS with the (R) next to their name .. they automatically get my vote... Just wait till the next election and they have someone running in the PRIMARY against them. (THIS SPACE RESERVED FOR A LONG STREAM OF VOLATILE EXPLETIVES)

I agree that everyone should demand that Obama veto this bill. The link given above is to a petition on the White House server. If it doesn't get 25,000 signatures by a certain date, the petition never gets to him. Sign the petition, but also send an email directly to Obama using this link: http://www.whitehouse.gov/contact/  Writing and calling the White House is another way to be heard. Also, do we know if the bill has even passed the Senate? If it has not, then we should all send emails to our Senators and call and write them telling them not to vote for the Levin-McCain amendment to make it part of the final bill that goes to the President

The NDAA only goes to further stifle our Constitutional Rights without the approval of the Americans, just as the Patriot Act was adopted WITHOUT public approval or vote just weeks after the events of 9/11.  A mere 3 criminal charges of terrorism a year are attributed to this act, which is mainly used for no-knock raids leading to drug-related arrests without proper cause for search and seizure.  The laws are simply a means to spy on our own citizens and to detain and torture dissidents without trial or a right to council.  You can read much more about living in this Orwellian society of fear and see my visual response to these measures on my artist’s blog at http://dregstudiosart.blogspot.com/2011/09/living-in-society-of-fear-ten-years.html

When will people learn that a gun is not power?  Had a weapon be power Jesus would have left no doubt showing us in the KJV.  Why do People rely on what the devil sees as power?
