Judicial Supremacy

The Breitbart News Article of July 1, 2015, “Scalia in Gay Marriage Ruling Dissent: Where are The Protestants?” illustrates how this Court has morphed judicial independence to mean ‘judicial supremacy’. Justice Antonin Scalia’s dissenting opinion admonished the court by saying that a “system of government that makes the People subordinate to a committee of nine unelected lawyers does not deserve to be called a democracy.” Scalia also observed that the “Federal Judiciary is hardly a cross – section of America. All nine men and women studied at Harvard or Yale Law School, with four of the nine natives of New York City.” His observation that not a “single evangelical Christian or even a Protestant of any denomination “ is found on the court consisting of six Catholic and three Jews questions how such an elite , homogeneous committee can presume to legislate over a constituency that finds itself wholly unrepresented as do Protestants . He continued, “The strikingly unrepresentative character of the voting body on today’s social upheaval would be irrelevant if they were functioning as judges. But of course the Justices in today’s majority are not voting on that basis.”

Justice Scalia compared the decision to England’s treatment of the American before the War of Independence, perpetrating a more serious offense than the one that ignited the American Revolution. Indeed “to allow the policy question to be considered and resolved by a select , patrician , highly unrepresentative panel of nine is to violate a principal even more fundamental than no taxation without representation: no social transformation without representation, “ he stated. “Today’s decree says that my Ruler of 329 million Americans coast –to-coast is a majority of nine lawyers on the Supreme Court,” he concluded. Two years prior, on 6/26/15, this same activist supreme court once again rejected their constitutional role and struck down the Defense of Marriage Act which defined marriage on a federal basis as “only a legal union between one man and one woman as husband and wife” because “DOMA rejects this long-established precept of states themselves determining the definition of marriage.” Two years later the same rules and logic did not apply.

Absolute Truths

Absolute truth is unvarnished and stands on its own merit. In spite of a secular society that champions a lack of moral plumb lines, there are absolute truths. These absolute truths are no better defined than excerpts from the sermon “Of Mice and Men” by Denton Bible Church’s Pastor Tommy Nelson. Listen to the first seven minutes and the final ten minutes.  Tommy Nelson concluded his sermon “Of Mice and Men” with the statement that heroes will arise from the Supreme Court’s decision on gay marriage. However the heroes will not be the scholars. They will be the ones with guts and fortitude.

This battle is between the sexual revolution and Christianity itself, not just between gay rights and religious liberty. The sexual revolution questions everything about sexual morality – demanding changes in every aspect of sexual morality and consequently, orthodox Christian theology. Their new definition of ‘Civil Rights’ has expanded to demand total elimination of dissent and total agreement with their viewpoint. The cultural left, while hoping to dominate the culture , is overreaching and succeeding in mainly hardening conservative resolve. Conservatives have the support of millions of Americans who oppose leftist bullying.¹ This battle may be over but the war has just begun.
