Texas Republican 2010 Platform Resolution: Stop Illegal Immigration
This week thousands of Republican Convention Delegates and Alternates from across Texas will travel to Dallas. The majority will arrive Thursday afternoon or Friday Morning, and return to their homes Saturday night. However there will be two groups that are already headed to Dallas. They include the members of the Platform Committee, and the Rules committee. Those folks will be in Dallas all week, and will work on committee business for ten hours or more every day! If you are attending as a Delegate, or Alternate, please thank these fine folks! They are the backbone of our party! The following is my proposed resolution for a sensible immigration policy.
Stop Illegal Immigration
Texans resolve to urge Congress to develop a SENSIBLE IMMIGRATION POLICY!
Americans deserve a policy that effectively controls our borders, positively identifies all non-citizens, deports those with violent criminal records. Immigrants that came here illegally of their own accord will have no pathway to citizenship with the exception of military service.
Work visas for non-citizens should be issued only to those who submit to a positive ID process including criminal background check and agree to pay substantial fines and penalty payroll taxes in excess of taxes paid by citizens.
Employers of non-citizens should be required to match those penalty payroll taxes as an incentive to hire U.S. citizens first!
What does this mean?
Sensible Immigration Reform requires we do everything possible to secure all ports of entry, sea shores, rivers, Mexican, and Canadian borders. America must demand cooperation with Mexico and Canada, enabling US Armed Forces to pursue and eliminate (with deadly force) the organized drug cartels, gangs, human smugglers, and terrorists. Any person suspected of entering our country illegally, who refuses to surrender to US Law Enforcement Officers, should be apprehended with whatever force is deemed necessary, including "deadly force.”
Since 9/11, our country has been at war with Islamic extremists. Our borders are porous. Therefore, Sensible Immigration Reform must include immediate positive identification and criminal background checks of all non-citizens residing in the US. In addition, a similar positive ID and criminal background check should be required of every US citizen who attained citizenship since 9/11.
Illegal Immigrants that willingly come forward to be positively identified and are found to have no violent criminal record would be granted LPI (Legal Prospective Immigrant) status. LPI status will be a ten year status during which they will be required to pay a monthly fine of $50 ($5000 in ten years). The LPI status will enable them to work and to travel. If they are employed, they will also pay penalty taxes of 150% of the MC/SS taxes citizens pay. The penalty MC/SS tax would be 11.4%, based on the current citizen tax of 7.6%. Immigrants will be allowed to apply to bring immediate family members after five years provided they have paid all fines and penalty taxes and completed English and civics courses, and can prove the ability to support their family.
After completing the ten years as LPI's the immigrant will be eligible to apply for LPR (Legal Permanent Residency Status). This would require a new positive ID and criminal background check. If the immigrant qualifies, and has paid all fines, penalty taxes, completed the required educational courses (learned to speak English), he or she will be granted LPR status. LPR's will no longer have to pay fines, but the penalty payroll taxes will apply to their earnings. Those immigrants that were adults when they came here illegally will be allowed no pathway to citizenship. LPR's that were brought here as minors will be able to go to the "back of the line" and apply for citizenship.
Under this immigration resolution, there are no short cuts to citizenship with the exception of military service. More than 50,000 immigrants have earned US citizenship via military service! Thank God they came here!
Misclassification of employees (calling employees independent contractors) is fraud. In Texas, it is often used to avoid Workers Compensation insurance. It avoids unemployment taxes, MC/SS taxes, etc. This violation of IRS rules costs taxpaying Americans untold billions annually! Sensible Immigration Reform cannot stop US citizens from misclassifying, but it can specify that LPI and LPR status immigrants can only be employed by employers that deduct and match taxes.
Finally, Sensible Immigration Reform must require employers to match the penalty taxes (11.4% MC/SS) paid by LPI and LPR immigrants. This rule will provide employers a financial incentive to hire citizens first!
